NOVAFUSE TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before 
using the novafuse.com website ("Site") operated by NOVAFUSE 
("we," "us," or "our"). By accessing or using the Site, you 
agree to be bound by these Terms.

1. GENERAL CONDITIONS
By using this Site, you represent that you are at least 18 years 
of age and that you have the legal authority to enter into these 
Terms. We reserve the right to refuse service to anyone for any 
reason at any time. Your use of the Site constitutes your 
agreement to these Terms in their entirety.

2. PRODUCTS & SERVICES
We reserve the right to modify, discontinue, or limit the 
availability of any product or service without prior notice. 
Product descriptions, images, and specifications are provided for 
informational purposes and may vary slightly from the actual 
product. Colors may appear differently depending on your device 
display settings.

All prices are listed in U.S. dollars (USD) and are subject to 
change without notice. We reserve the right to correct any 
pricing errors and to cancel orders placed at incorrect prices.

3. ACCURACY OF INFORMATION
We make reasonable efforts to display accurate product 
information, pricing, and availability. However, we do not 
warrant that product descriptions, pricing, or other content on 
the Site is complete, accurate, reliable, current, or error-free. 
If a product offered on the Site is not as described, your sole 
remedy is to return it in unused condition in accordance with our 
Return & Refund Policy.

4. ORDER ACCEPTANCE & CANCELLATION
Your placement of an order constitutes an offer to purchase. We 
reserve the right to accept or decline any order at our sole 
discretion. Orders may be cancelled by us if:
- The product is unavailable or out of stock
- Pricing or product information errors are identified
- We suspect fraudulent or unauthorized activity
- The order violates any of these Terms

Order cancellation requests by the customer must be submitted 
within 12 hours of order placement by emailing 
support@recovry.com. Orders that have already entered processing 
or shipment cannot be cancelled and must follow our Return & 
Refund Policy.

5. PAYMENT
We accept major credit cards, debit cards, and other payment 
methods as displayed at checkout. By submitting payment, you 
represent that you are authorized to use the payment method 
provided. All payments are processed through secure third-party 
payment processors. We do not store your complete credit card 
information on our servers.

6. MEDICAL DISCLAIMER
NOVAFUSE products are cosmetic skincare devices intended for 
topical use only. Our products are NOT medical devices and are 
not intended to diagnose, treat, cure, or prevent any disease 
or medical condition.

Results described on this Site, in marketing materials, or in 
customer testimonials are individual experiences and are not 
guaranteed. Individual results may vary based on skin type, age, 
usage consistency, and other factors.

The information provided on this Site is for general informational 
purposes only and should not be considered medical advice. Consult 
a licensed dermatologist or healthcare provider before using any 
skincare device, especially if you have sensitive skin, active

NOVAFUSE is not responsible for adverse reactions resulting from 
product misuse, failure to follow included instructions, use on 
contraindicated skin conditions, or allergic reactions to 
ingredients.

7. INTELLECTUAL PROPERTY

images, graphics, logos, product names, trade dress, videos, and 
software — is the property of NOVAFUSE or its licensors and is 
protected by U.S. and international copyright, trademark, and 
intellectual property laws.

You may not reproduce, distribute, modify, display, or create 
derivative works from any content on this Site without prior 
written permission from NOVAFUSE.

"NOVAFUSE" is a trademark of NOVAFUSE. Unauthorized use of our 
trademarks is strictly prohibited.

8. USER CONDUCT
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site
- Interfere with or disrupt the Site's functionality
- Submit false, misleading, or fraudulent information
- Use automated tools (bots, scrapers, etc.) to access the Site
- Resell or commercially exploit any products purchased from the 
  Site without written authorization

9. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services 
that are not owned or controlled by NOVAFUSE. We are not 
responsible for the content, privacy policies, or practices of 
any third-party sites. You access third-party links at your own 
risk.

10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOVAFUSE, ITS 
OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT 
BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, 
OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, 
DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE SITE
- ANY PRODUCTS PURCHASED THROUGH THE SITE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS 
  OR DATA

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS 
ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE 
EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS 
PRECEDING THE CLAIM.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless NOVAFUSE and 
its affiliates, officers, directors, employees, and agents from 
any claims, liabilities, damages, losses, costs, or expenses 
(including reasonable attorneys' fees) arising from:
- Your use of the Site or products
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Site

12. DISPUTE RESOLUTION
Any disputes arising from or relating to these Terms or your use 
of the Site shall be resolved through binding individual 
arbitration in accordance with the rules of the American 
Arbitration Association (AAA). Arbitration shall take place in 
the Commonwealth of Virginia.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE 
CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, 
CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. GOVERNING LAW
These Terms shall be governed by and construed in accordance 
with the laws of the Commonwealth of Virginia, without regard 
to its conflict of law provisions.

14. CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time 
without prior notice. Changes are effective immediately upon 
posting to the Site. Your continued use of the Site following 
any changes constitutes acceptance of the updated Terms.

15. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, 
or unenforceable, the remaining provisions shall continue in full 
force and effect.

16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Shipping Policy, 
and Return & Refund Policy, constitute the entire agreement 
between you and NOVAFUSE regarding your use of the Site.
